Leesa Bunch vs. Hoffinger Industries is the case to be analyzed in this paper. Leesa Bunch was injured while diving into an aboveground pool produced by Hoffinger Industries. The girl’s life was changed. He mother suited the company for having produced a low quality pool. The first case was win by the Bunches. Hoffiner Industries appealed to the court. The company’s barristers claimed that it was the girl’s fault and not the company’s. However, right after the appeal has been filed, Hoffinger Industries went bankrupt.
The parties presented relevant evidence and arguments to support their points of view. The main argument was that it was the girl’s fault. However, the Bunches asked Ross Buck to become an expert at the court. Ross Buck agreed. His testimony was one of the reasons why Hoffinger Industries did not win the case.
The main problem that the party posed to the court was whether the company was guilty in not placing a warning sign on the pool’s sides or not. The court decided that the company Hoffinger Industries should have researched every dangerous situation that might occur when swimming or diving in the aboveground pool. The court’s decision was affirmed.
The rule of law is that the company is to warn its customers about even a slightest danger that may appear while using a product. The company should do everything possible to preserve any harm. The court heard all the evidence and decided that the company Hoffinger Industries should pay the Bunches quite a significant sum of money. The court was deciding for quite a long time. however, the Bunches got what they needed and the company was punished severely.
